Terms of Service for BizManna

1. Acceptance of Terms

BizManna ("the Platform") is owned and operated by BizManna LLC ("BizManna," "we," "us," or "our"), a limited liability company. When you purchase or use the Platform, you are entering into an agreement with BizManna LLC.

By accessing or continuing to use the Platform, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Eligibility

You must be at least 18 years old and represent a valid business entity to use BizManna. By connecting any third-party account, you warrant that you have the legal authority to act and post on behalf of that business or entity.

3. The Service & Subscriptions

BizManna provides an AI-driven growth engine designed to assist with business strategy, social media, advertising, and SEO.

• AI Output & Responsibility: You acknowledge that BizManna utilizes generative AI. While advanced, AI may produce inaccurate or biased information. You are the final editor. You are responsible for reviewing and approving all content before it is published. Approval or publication of AI-generated content constitutes your assumption of full legal responsibility for its compliance with platform standards and advertising laws.
• Subscription & Billing: The BizManna membership is billed at $117/month on a recurring basis. The Daily Win Business Bootcamp is a separate one-time purchase.
• Merchant of Record: Our order process is conducted by Stripe, which acts as Merchant of Record for our orders and handles payment, billing, currency, sales tax and VAT, invoicing, and renewal mechanics. Charges may appear on your statement as LINK.COM* BizManna. Billing questions can go to Stripe or directly to us at support@bizmanna.io.
• Cancellation Policy: You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain full access to the Platform and its modules until the end of your current paid billing period.
• Refunds: We offer a 14-day money-back guarantee. Full details are in our Refund Policy.

4. API Usage and Authorization

When you connect your accounts (including but not limited to Meta, Google, LinkedIn, and X) to BizManna:

• Grant of Authority: You grant BizManna permission to access, retrieve data from, and post to those accounts to execute the tasks you approve within the Platform.
• Google API Compliance: BizManna's use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. We do not sell your Google data or use it to serve advertisements.
• Third-Party Terms: You agree to comply with the individual Terms of Service of each connected platform.

5. Data Deletion & Revocation

You may revoke BizManna's access to your third-party accounts at any time.

• Meta (Facebook/Instagram): You may disconnect via your Facebook "Apps and Websites" settings. For full instructions on historical data deletion, please visit bizmanna.io/data-deletion.
• Google: You may revoke access via your Google Security settings.

6. Prohibited Conduct

You agree not to use BizManna to:

• Generate or distribute spam, hate speech, or illegal content.
• Attempt to reverse engineer the Platform or bypass security protocols.
• Use AI-generated content in a manner that violates the "Originality" or "Community Standards" of connected platforms.

Acceptable Use of Email and Outreach Tools

BizManna's outreach tools send email through your own mailbox using credentials you provide. You remain the sender of record and are solely responsible for compliance with CAN-SPAM, CASL, GDPR, and any other law that applies to your messages. By using these tools you agree that you will:

• Only contact people you have a legitimate business reason to reach, and never send to purchased, scraped, or rented contact lists.
• Honor every opt-out request promptly. BizManna appends an opt-out line to sequenced emails, and you must stop contacting anyone who asks.
• Use accurate sender names, subject lines, and a valid reply-to address, and never disguise who you are.
• Stay within the platform's daily sending limits and not attempt to circumvent them with multiple accounts.

We may suspend or terminate accounts that generate spam complaints, high bounce rates, or that we reasonably believe are being used for unsolicited bulk messaging.

6a. AI-Generated Content

BizManna includes generative AI tools. The following terms apply to your use of them.

• Acceptable Use: You may not use our AI tools to create illegal content, sexual content involving minors, harassment or hate speech, deepfakes or impersonations of real people, malware, disinformation, or content designed to defraud. You may not attempt to jailbreak, prompt-inject, or otherwise circumvent the safety controls of the underlying models.
• Your Responsibility: You are responsible for the prompts and materials you submit, for confirming you hold the rights to any content you upload, for reviewing outputs before you publish them, and for how those outputs are used.
• Inputs and Outputs: You retain ownership of the business information you submit, and you grant us a limited license to process it solely to deliver the service. As between you and BizManna, outputs generated from your inputs are yours to use, subject to these terms. Generative models can produce similar results for different users, so we can't guarantee that any output is unique.
• Rights-Holder Complaints: If you believe content generated or hosted through BizManna infringes your intellectual property, email support@bizmanna.io with the details and we'll investigate and remove infringing material where appropriate. Accounts responsible for repeated infringement will be suspended or terminated.
• Content Moderation: We may filter, refuse, restrict, or remove prompts and outputs, and suspend accounts, where we reasonably believe these terms or the policies of a connected platform have been violated.
• Accuracy: AI outputs may be inaccurate, incomplete, or out of date. Nothing produced by BizManna is legal, financial, tax, medical, or other regulated professional advice, and it should not be relied on without your own review and judgment.

7. Limitation of Liability

BizManna is provided on an "as is" and "as available" basis.

• No Guarantees: We do not guarantee specific business results, follower growth, search engine rankings, or ad performance (ROAS).
• Account Actions: We are not liable for any account suspensions, "shadowbans," or restrictions imposed by third-party platforms (Meta, Google, etc.) resulting from your use of AI-generated content or automated outreach.
• Financial Loss: We are not liable for any business losses or accidental ad-spend "overages" occurring on third-party platforms.

8. Termination

BizManna LLC retains all right, title, and interest in the Platform, including its software, documentation, templates, prompts, and branding. You receive a limited, non-exclusive, non-transferable right to use the Platform under your active plan. You own the content you create with it. The Platform is provided on an "as is" basis and we don't guarantee uninterrupted or error-free performance.

We reserve the right to suspend or terminate accounts that violate these terms, our internal safety guidelines, or the terms of our API partners, as well as for non-payment, security or fraud risk, or repeated policy violations.
